End User License Agreement

A. Authorized use

Under the terms of this license, you may:

Use the unlicensed software on any number of computers at any one time; and

A.1 Copy and distribute verbatim copies of the unlicensed distribution as you receive it, in any medium, provided that you do not modify it any fashion, keep intact all the notices that refer to this license and to the absence of any warranty, and do not pass on any user registration details which you have received. If you distribute copies of this software, you shall not charge anything except the cost of the media and a fair estimate of the costs of computer time or network time directly attributable to the copying.

A.2 In addition, licensed users may use one copy of the licensed software on only the number of computers specified in the license..

A.3 The Licensed Software is "in use" when it is loaded into random access memory or installed on a hard disk or other storage device.

Installing the Licensed Software on a network server solely for the purpose of internally distributing the Licensed Software shall not constitute "in use", provided that you have a license for each computer to which the
Licensed Software is distributed.

A.4 Use of the unlicensed software is limited to an evaluation period. Past this period of evaluation, you must either purchase a license or delete the unlicensed software from all computers.

B. Restrictions

You shall not:

B.1 Use, copy, modify, translate or merge the software except as provided in this agreement

B.2 Reverse-engineer, disassemble, or decompile the software

B.3 Sublicense, rent, lease, or assign any portion of the software

B.4 Transfer the Software to any other party except as provided for in section A.1

B.5 Transfer registration details to any other party without the express permission of Xenos Software LLC in writing

C. Copyright

The Software is owned by Xenos Software LLC and is protected by United States of America copyright laws and international treaty provisions. You shall treat the software like any copyrighted material.

D. Limited Warranty

EXCEPT AS EXPRESSLY STATED HEREIN, THE
SOFTWARE IS PROVIDED "AS IS." YOU SHALL
BE ENTIRELY RESPONSIBLE FOR THE SELECTION OF THE SOFTWARE AND FOR THE INSTALLATION OF, USE OF, AND RESULTS OBTAINED FROM THE SOFTWARE.

ALL OTHER WARRANTIES OR CONDITIONS,
EITHER EXPRESS OR IMPLIED, INCLUDING BUT
NOT LIMITED TO IMPLIED WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE, WITH RESPECT TO
THE SOFTWARE AND WRITTEN MATERIALS
ACCOMPANYING THE SOFTWARE, ARE
EXCLUDED FROM THE LICENSE.

E. No liability for Consequential Damages

TO THE MAXIMUM EXTENT PERMITTED BY
APPLICABLE LAW, IN NO EVENT SHALL
XENOS SOFTWARE LLC BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THIS XENOS SOFTWARE LLC PRODUCT, EVEN IF XENOS SOFTWARE LLC HAS BEEN
ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

F. General

Should you purchase a license to the software Xenos Software LLC reserves the right to list your company name as a user of the software in promotional material. You may request at any time to exclude your company name from this list by contacting Xenos Software LLC.

This license and your right to use the software shall terminate automatically if you violate any part of this agreement. In the event of termination, you shall immediately destroy all copies of the software or return them at your expense to Xenos Software LLC.
